Making Accommodations
Upon indicating to the successful candidate that you are recommending him/her pending the background check and verification of the release of his/her previous contract, it is important to ask if, in order to perform the essential functions of the job per the job description, he/she needs accommodation. Per the Americans with Disabilities Act, employers are required to make reasonable accommodation if an employee has
  1. a physical or mental impairment that substantially limits one or more of the major life activities of such individual;
  2. a record of such an impairment; or
  3. being regarded as having such an impairment.

If the candidate says, "yes" to the above question, ask him/her to define what accommodations he/she will need. You may want to ask him/her to submit a physician's statement verifying the need for the requested accommodation. Work with your attorney if you want more assistance with determining if a request for accommodation is reasonable.
