A school board has only 72 hours to make a difference in the lives of students.

If a board meets twice a month, averaging three hours per meeting, that's two meetings times three hours times twelve months...72 hours! That's not a long time to make a difference in the lives of children—which is the primary reason community members run for their local board.

The Code of Iowa must speak directly to board members and to a school district. Dillon's rule states that unless a law authorizes school boards to take an action, they cannot take that action. We can only do what we are told, specifically, that we can do!

The Iowa Code speaks in a variety of voices.
  • From the very specific, "Notice of a suspension shall be immediately sent to the President of the Board" 282.4(2) to the very general, "The board shall make rules for its own government..." 279.8
  • From the prescriptive, "...shall adopt goals to improve student achievement and performance" (280.18) to the possible, "Boards of Directors in all public school district may establish and maintain dental clinics for all children..." (2280.7)
  • From the prohibitive "...initial contract with a superintendent shall not exceed one year if the board is obligated to pay a former superintendent under an unexpired contract" to telling us what must be done, "...superintendent shall be the executive officer of the board..."
The Iowa Code gives the board power and also limits their power (280.19). It is clarified by rules. (Chapter 256). It addresses board responsibilities: the board's duty to bargain (Chapter 20), to meet in the open (Chapter 21).

When a superintendent is uncertain about the appropriateness and/or legality of a board action, consult your board policy, consult experts in the field (SAI, IASB), consult your school attorney. This is the classic, "It is better to be safe than sorry!"
